Protective Orders for Children

Obtaining emergency protective orders and domestic violence orders to safeguard children from abuse.

Child in immediate danger? Call 911.Kentucky Child Abuse Hotline: 1-877-KYSAFE1

When a child is in danger, waiting for the slow pace of regular court proceedings isn't an option. Protective orders provide immediate legal protection, ordering an abuser to stay away from the child and potentially removing them from the home.

Kentucky offers several types of protective orders. We help clients understand which type fits their situation and guide them through the process of obtaining emergency protection quickly.

What You Should Know

Emergency Protective Orders (EPOs) can be obtained same-day, even after hours
Domestic Violence Orders (DVOs) can protect children from household members
Interpersonal Protective Orders (IPOs) protect against non-household abusers
Violating a protective order is a criminal offense
Protective orders can include custody and visitation provisions
Orders can be obtained on behalf of children by parents or guardians

What Protective Orders Can Do

Order the abuser to stay away from the child
Remove the abuser from the family home
Grant temporary custody to the protective parent
Establish supervised or no visitation
Order the abuser to surrender firearms
Prohibit contact by phone, text, email, or through third parties
Order the abuser to attend counseling or treatment
Provide protection at school and childcare

The Process

  1. 1Emergency Filing
We prepare and file a petition for emergency protection. EPOs can be obtained within hours, including after regular court hours.
  2. 2Temporary Order
A judge reviews the petition and, if danger is shown, issues a temporary order immediately effective upon service.
  3. 3Service on Respondent
The abuser must be served with the order. The order is enforceable once they have notice.
  4. 4Full Hearing
Within 14 days, a full hearing is held where both sides present evidence. We prepare you thoroughly for this hearing.
  5. 5Final Order
If the court finds domestic violence or abuse occurred, a final order is issued lasting up to 3 years.

Frequently Asked Questions

How quickly can I get protection?

Emergency Protective Orders can be obtained the same day you file. Judges are available after hours and on weekends for true emergencies.

What if the abuser violates the order?

Violating a protective order is a criminal offense. Call 911 immediately if the order is violated. Document all violations.

Can a protective order affect custody?

Yes. DVOs can include temporary custody provisions. A DVO can also impact later custody proceedings, as courts consider domestic violence when determining the child's best interests.
