Stepparent Adoption
Stepparent adoption creates a permanent legal relationship between a stepparent and their stepchild. This process terminates the parental rights of the non-custodial biological parent and establishes the stepparent as a legal parent.
Stepparent adoption is one of the most common types of adoption in Kentucky. When a stepparent adopts their spouse's child, they gain all the legal rights and responsibilities of a biological parent.
The process requires consent from both biological parents, unless parental rights have been terminated or the non-custodial parent is deemed unfit. In some cases, consent may be waived if the biological parent has abandoned the child.

- Married to the custodial parent
- Consent from the non-custodial parent (or termination of their rights)
- Criminal background check
- Home study (in some cases)
- Filing of adoption petition
- Court hearing for finalization
