Contested Adoption
A contested adoption is a way for an adoption to happen when one or both biological parents refuse to consent to the adoption, provided certain legal requirements (such as abandonment, e.g.) are met. Often, contested adoptions happen only after an extensive court trial. The Heinrich Firm dedicates a large percentage of its practice representing the families that have chosen to love the children that others have let down.
When the family is there, but not the blood. When the biological parents have been absent or less than adequate and custodians want something more permanent, contested adoption may be the path forward.
We guide families through the legal requirements under KRS 199.520, including the 180-day placement, CHFS background check, home study when required, and court process. We work to secure the permanent family your child deserves.
Requirements
- Child/ren in your home for at least 180 days
- Biological parents that meet the requirements of KRS 199.520
- CHFS background check
- Home study (in some cases)
- Attempting to get consent from biological parents
- Filing of adoption petition
- Review of Kentucky Paternity Registry
- Retrieving and organizing all information needed
- Court hearing for finalization
