What's the difference between legal and physical custody?

Legal custody involves decision-making authority for major issues like education, healthcare, and religion. Physical custody (usually referred to as "parenting time" in Kentucky) refers to where the child lives and how he or she spends time with both parents. Parents can share both types of custody jointly or one parent may have primary custody.

At what age can a child choose which parent to live with?

Kentucky law considers a child's preference if they're of "sufficient age and maturity." There's no specific age and courts sometimes give weight to preferences of children, though it's never the only factor. A Friend of the Court (FOC) is a lawyer, therapist, or other professional appointed by the court to investigate and report back their findings through writing a report. They then can be called to testify at a hearing and give hearsay evidence based on what they were told. Can grandparents get visitation rights?
